Anfang März ist ein in der Sicherungsverwahrung der JVA Berlin-Tegel Untergebrachter von seinem Ausgang nicht zurückgekehrt. Das Medienecho war enorm. Wie haben Sie die Berichterstattung wahrgenommen?

Fast reflexartig lief das ab, was der Kriminologe Stanley Cohen in den 1960er Jahren als »Moral Panic« beschrieb: Einzelfälle werden verzerrt und übertrieben, um eine Bedrohung für die Ordnung unserer Gesellschaft zu konstruieren. Die Typisierung als »gefährlicher Vergewaltiger« oder »Schwerstverbrecher« ist scharf zu verurteilen. Auch wenn die Anlasstat für die Sicherungsverwahrung eine Vergewaltigung gewesen ist, liegt diese immerhin über 18 Jahre zurück (2001 wurde das Urteil gesprochen, seit 2011 bestand Sicherheitsverwahrung; jW). Gegen das medial erzeugte Bild eines unverbesserlichen Triebtäters sprechen nicht zuletzt die 191 Ausgänge des Mannes, die ohne Beanstandung verliefen. Fälschlicherweise berichteten einige Medien, der Untergebrachte sei geflohen beziehungsweise entwichen. Flucht und Entweichung sind aber Begriffe für einen Gefängnisausbruch. Tatsächlich ist der Betroffene lediglich von seinem Ausgang nicht zurückgekehrt. Juristisch gesagt: Er hat seine Lockerungsmaßnahme missbraucht. Das mag sprachlich spitzfindig klingen, trägt aber zu einer Entdämonisierung bei.

Die Berichterstattung über Delikte sexualisierter Gewalt sind stark emotional aufgeladen. Das überrascht Sie?

Wenn man von dem medialen Dogma »Sex and Crime sells« ausgeht, sicher nicht. Gefährlich bei kriminalpolitisch brisanten Themen wird es dann, wenn eine sachgerechte Berichterstattung kaum mehr stattfindet und statt dessen unreflektiert Emotionen geschürt werden. So wird die Gesellschaft verunsichert und werden Bevölkerungsgruppen stigmatisiert und unter Generalverdacht gestellt.

Der Betroffene wurde übrigens zwei Tage nach dem Lockerungsmissbrauch gefasst. Das war den meisten Medien keine Meldung mehr wert.

Die heutige Sicherungsverwahrung hat ihren Ursprung in Nazideutschland von 1933. Was ist davon in die bundesdeutsche Rechtsprechung eingegangen?

Während die Sicherungsverwahrung in der DDR bereits im Jahre 1952 als »inhaltlich faschistisch« betrachtet und mithin aufgegeben wurde, zeigte sich die Rechtsprechung in der BRD davon unbeeindruckt. Selbst die schrittweise Verschärfung der Sicherungsverwahrung ab 1998 und die Einführung der nachträglichen Sicherungsverwahrung im Jahre 2004 wurden zunächst gebilligt. Erst 2011 reagierte das Bundesverfassungsgericht auf eine Verurteilung Deutschlands durch den Europäischen Gerichtshof für Menschenrechte und erklärte die Sicherungsverwahrung in ihrer damaligen Form für verfassungswidrig.

Sicherungsverwahrte sind formal keine Gefangenen. Worin liegen konkret die Unterschiede?

Menschen, die in der Sicherungsverwahrung untergebracht werden, haben ihre Strafe bereits vollständig verbüßt, unterliegen jedoch weiterhin einem zeitlich unbestimmten Freiheitsentzug. Die Maßnahme knüpft somit nicht an die Schuld, sondern einzig an eine prognostizierte Gefährlichkeit für die Allgemeinheit an.

Berlins Justizsenator Dirk Behrendt von den Grünen prüft einen offenen Vollzug für Sicherungsverwahrte. Eine richtige Initiative?

Definitiv! Dem offenen Vollzug kommt eine tragende Rolle für die Entlassungsvorbereitung und damit dem Schutz der Allgemeinheit vor weiteren Straftaten zu. Es darf nicht vergessen werden, dass nur diejenigen in den offenen Vollzug verlegt werden sollen, die sowieso vor ihrer Entlassung stehen. Der Erfolg dieses Konzepts wird nicht mehr bestritten.

Negativ stößt auf, dass die Berliner CDU den aktuellen Fall instrumentalisiert, um die Überlegungen zum offenen Vollzug für Sicherungsverwahrte in Frage zu stellen. Der stellvertretende Vorsitzende der CDU-Fraktion, Sven Rissmann, warnte den Justizsenator davor, er solle keine Entscheidungen aus »ideologischen Gründen« treffen. Er übersieht dabei, dass der offene Vollzug neben der Umsetzung höchstrichterlicher Rechtsprechung zwingende Folge des Berliner Sicherungsverwahrungsvollzugsgesetzes ist – das 2013 unter dem damaligen CDU-Justizsenator Thomas Heilmann verabschiedet wurde.
